Regulations on Import and Export of Precursor Chemicals Changed for FFE       

The Ministry of Commerce (MOC) confirmed that from April 1st, 2009, the import and export of precursor chemicals by foreign-funded enterprises (FFE) is to be managed by the Department of Mechanical and Hi-Tech Industry (hereafter referred to as the Industry Department) of MOC. At the same time, the technical platform will be changed from the previous FFE precursor chemicals import and export management network to MOC's government affairs platform for administering the import (export) of dual-use items and technologies (i.e. sensitive items and technologies as well as precursor chemicals). Other corresponding changes include:
    1. FFEs who apply to import or export precursor chemicals shall submit the application form in accordance with the current "Precursor Chemicals Management Ordinance."
    2. FFEs who apply for a license to import and export precursor chemicals shall report to the MOC via its government affairs platform for administering the import (export) of dual-use items and technologies.
    3. When a FFE applies to import or export precursor chemicals listed in the 2nd and 3rd catalogues that need no international check, provincial bureaus shall examine the application materials and then report to the Industry Department of MOC for recording.  
    4. When a FFE applies to import precursor chemicals that need international check, provincial bureaus shall handle the elementary examination first, and then turn over to the Industry Department of MOC for approval.
    5. When a FFE applies to export precursor chemicals that need international check, provincial bureaus shall handle the elementary examination first, and then turn materials over to the Industry Department of MOC for approval and going through the international check.
