Law Enforcement Bureau for Antimonopoly and Anti-Unjust Competition Established

Chinese Antimonopoly Law has been effective since August 1st, 2008.
The State Administration for Industry and Commerce has established the Law Enforcement Bureau for Antimonopoly and Anti-Unjust Competition, which takes charge of drawing up specific measures/methods for antimonopoly and anti-unjust competition and organizing their implementation, investigating into/ prosecuting cases related to monopoly agreements (except price monopoly agreements) and abuses of market dominating positions as well as illegal economic cases such as unjust competition, commercial bribery and smuggling, and supervising over major/typical cases.
It is stipulated in the General Provision of the Antimonopoly Law that the State Council should form the Antimonopoly Commission to organize, coordinate and guide the antimonopoly issues. The State Council has however not yet established such a commission.
The National Development and Reform Commission is in charge of investigation and prosecution on acts related to price monopoly agreements. The Ministry of Commerce is in charge of antimonopoly examination on mass acts of operators.
