3.2 Production and trading licensing of precursors and chemicals used in production of narcotic drugs and psychotropic substances

It is stipulated in the "Measures for Licensing the Production and Trading of Non-Drug Precursors and Chemicals Used in Production of Narcotic Drugs and Psychotropic Substances" (No. 5 Decree, 2006 issued by the State Administration of Work Safety on April 5th, 2006) that to strengthen the administration of non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances, standardize their production and trading, prevent them from being used in production of narcotic drugs and psychotropic substances and safeguard the economic and social order, the "Measures" is formulated in accordance with relevant laws and regulations such as the "Regulations for the Administration of Precursors and Chemicals Used in Production of Narcotic Drugs and Psychotropic Substances". Non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances in the "Measures" refer to major raw materials and chemical formulations listed in the table attached to the "Regulations for the Administration of Precursors and Chemicals Used in Production of Narcotic Drugs and Psychotropic Substances". China implements the licensing system to the production and trading of precursors and chemicals used in production of narcotic drugs and psychotropic substances. The license administration is exercised to the production and trading of the first category of non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances. The filing certificate administration is exercised to the production and trading of the second and the third categories of non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances. Departments of work safety supervision and administration in governments of provinces, directly under the central government undertake the examination, approval and license issuing to the production and trading of the first category of precursors and chemicals used in production of narcotic drugs and psychotropic substances in their administrative regions. Departments of work safety supervision and administration in governments of cities undertake the filing certificate issuing to the production and trading of the second category of precursors and chemicals used in production of narcotic drugs and psychotropic substances and the filing certificate issuing to the production of the third category of precursors and chemicals used in production of narcotic drugs and psychotropic substances in their administrative regions. Departments of work safety supervision and administration at the county level undertake the filing certificate issuing to the trading of the third category of precursors and chemicals used in production of narcotic drugs and psychotropic substances in their administrative regions. The State Administration of Work Safety undertakes the national supervision and guidance to the production and trading license and filing administration of non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances. Departments of work safety supervision and administration in local government at and above the country level are in charge of the supervision and administration to the implementation of the production and trading licensing system to non-drug precursors and chemicals used in production of narcotic drugs and psychotropic substances in their administrative regions.
