Court Rules in Favor of BASF in Patent Litigation

By Tanya Tian
A recent patent litigation case was ruled in favor of BASF and against the chemical manufacturer Shouguang Shuangxing Pesticide Co., Ltd., a pesticide producer located in Shandong province, and its distributor in Jiangsu province, by the Jiangsu Higher People's Court, China. This judgment came into force immediately in December 2007. BASF released the press on March 10th.
The court found Shouguang Shuangxing to illegally offer three products with BASF's active ingredient chlorfenapyr. The judgment orders the infringer to cease the production and offer of patented products without BASF's authorization. Shouguang Shuangxing was ruled to destroy all infringing products and to pay appropriate damage compensation in addition to BASF's costs for court actions.
BASF says it will continue its effort in protecting the interests of its customers and business partners to ensure sustainable development in the agrochemical industry.
